Disclaimer & Terms of Use for AKL 2.0 Automated Strategy Indicator (Automated and Manual)

AKL Group LLC (“AKL Group,” “we,” “us,” or “our”) provides the AKL 2.0 Automated Strategy Indicator and any related indicators, scripts, tools, automations, alerts, integrations, documentation, training materials, and updates (collectively, the “Indicator”) for informational and educational purposes only.

 

Makki Brothers is a subsidiary of AKL Group LLC. References in this Disclaimer to AKL Group LLC include Makki Brothers and all other AKL Group subsidiaries, affiliates, owners, officers, directors, employees, contractors, representatives, and agents (collectively, the “AKL Parties”).

 

By accessing, installing, using, purchasing, subscribing to, or relying on the Indicator in any manner, you (“User” or “you”) agree to this Disclaimer & Terms of Use. If you do not agree, do not access or use the Indicator.

 

 

1. No Financial Advice

 

The Indicator is not intended to provide—and does not provide—financial, investment, trading, tax, legal, or accounting advice. Nothing within the Indicator (including signals, entries/exits, alerts, strategy logic, backtests, performance outputs, charts, commentary, or educational content) constitutes a recommendation, solicitation, or offer to buy, sell, or hold any security, futures contract, option, cryptocurrency, or other financial instrument.

 

You acknowledge that:

 

• The Indicator is general in nature and not personalized to your financial situation, objectives, or risk tolerance.

• You are solely responsible for your trading decisions and outcomes.

• You should consult qualified professionals before making financial or trading decisions.

 

 

2. Risk Disclosure (High Risk / Potential Total Loss)

 

Trading and investing involve substantial risk and are not suitable for all individuals. You can lose some or all of your capital, and losses can occur rapidly—especially when trading leveraged products such as options and futures.

 

You acknowledge and agree that:

 

• Past performance, backtests, hypothetical results, and simulated performance are not indicative of future results.

• Market conditions can change quickly due to economic, political, technological, liquidity, volatility, news events, exchange or broker actions, or other factors.

• The Indicator’s logic is based on historical data and technical methods and cannot predict future market movements.

• Automated or semi-automated trading may place orders faster than you can react, increasing the risk of unexpected losses.

 

 

3. Educational / Informational Use Only

 

The Indicator is provided for educational and informational purposes. Any examples, explanations, templates, or demonstrations are illustrative and may not reflect real market conditions (including slippage, spreads, commissions, latency, execution quality, partial fills, platform limitations, data errors, or broker restrictions).

 

 

4. No Guarantees; “As-Is” / “As-Available”

 

The Indicator is provided “AS IS” and “AS AVAILABLE.” The AKL Parties make no representations, warranties, or guarantees of any kind—express or implied—regarding the Indicator or its outputs, including but not limited to accuracy, completeness, reliability, timeliness, merchantability, fitness for a particular purpose, non-infringement, or that the Indicator will be uninterrupted, secure, error-free, or profitable.

 

Without limitation:

 

• Alerts may trigger late, early, incorrectly, or not at all.

• Data feeds may be delayed, inaccurate, or incomplete.

• Platform changes (e.g., TradingView updates) may break features.

• Integrations (webhooks, brokers, automation services) may fail or behave unexpectedly.

 

You assume full responsibility for verifying outputs and for all decisions made using the Indicator.

 

 

5. Platform, Broker, and Third-Party Services (No Control / No Responsibility)

 

The Indicator may be used with third-party platforms and services (including but not limited to TradingView, brokers, exchanges, data providers, VPS providers, webhook routers, and automation tools). These third parties are not controlled by the AKL Parties.

 

You acknowledge and agree:

 

• The AKL Parties are not responsible for third-party outages, fills, execution quality, slippage, spreads, margin calls, liquidations, rejected orders, connection failures, or account restrictions.

• You are solely responsible for configuring alerts, webhooks, broker connections, order permissions, position sizing, risk controls, and all related settings.

 

 

6. User Responsibility; Suitability; Account Security

 

You are solely responsible for:

 

• Determining whether the Indicator is suitable for you;

• Your risk management, position sizing, account settings, and trading rules;

• Monitoring all trades and automations;

• Maintaining the confidentiality and security of your devices, platform logins, broker credentials, API keys, webhook URLs, and any integration secrets.

 

You agree not to rely on the Indicator as your only source of information and to confirm orders and positions independently.

 

 

7. Limitation of Liability

 

To the fullest extent permitted by law, the AKL Parties will not be liable for any damages arising out of or related to your access to or use of (or inability to use) the Indicator, including but not limited to:

 

• Trading losses (including total loss of capital)

• Lost profits or missed opportunities

• Data loss, business interruption, or reputational harm

• Indirect, incidental, special, consequential, exemplary, or punitive damages

 

This limitation applies regardless of legal theory (contract, tort, negligence, strict liability, or otherwise) and even if any AKL Party has been advised of the possibility of such damages.

 

If any liability is found notwithstanding the above, you agree that the total aggregate liability of the AKL Parties will be limited to the amount you paid to AKL Group LLC for access to the Indicator during the thirty (30) days immediately preceding the event giving rise to the claim, or $100, whichever is greater, unless prohibited by law.

 

 

8. Indemnification

 

You agree to indemnify, defend, and hold harmless the AKL Parties from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

 

• Your use or misuse of the Indicator

• Your violation of these terms

• Your violation of any law, regulation, exchange rule, or third-party right

• Any orders placed, trades executed, or losses incurred through your accounts or integrations

 

 

9. Intellectual Property; License Restrictions

 

The Indicator (including code, logic, algorithms, scripts, templates, branding, names, trademarks, and related materials) is proprietary to AKL Group LLC and protected by intellectual property laws.

 

You are granted a limited, revocable, non-exclusive, non-transferable license to use the Indicator solely for your personal use (or internal business use if explicitly authorized in writing by AKL Group LLC), subject to these restrictions:

 

You may not:

 

• Copy, reproduce, sell, resell, rent, lease, sublicense, distribute, publish, or share the Indicator or any part of it

• Reverse engineer, decompile, disassemble, or attempt to extract source logic where not already provided

• Create derivative works, clones, or competing products based on the Indicator

• Remove or alter proprietary notices, watermarks, or branding

• Share access credentials, invite links, private scripts, or protected files with any third party

 

Unauthorized use may result in immediate termination of access and legal action.

 

 

10. Compliance With Laws; No Regulatory Relationship

 

You are responsible for compliance with all applicable laws and regulations in your jurisdiction, including securities and derivatives laws and exchange rules.

 

Nothing in the Indicator creates any fiduciary duty, advisory relationship, broker-dealer relationship, or investment adviser relationship between you and any AKL Party.

 

 

11. Termination; Access Control

 

We may suspend, restrict, or terminate access to the Indicator at any time if:

 

• You violate these terms,

• We suspect unauthorized sharing, misuse, or security risks, or

• Continued access would create legal or operational risk.

 

Termination does not limit any rights or remedies available to the AKL Parties.

 

 

12. Updates and Changes

 

We reserve the right to modify, update, replace, or discontinue the Indicator (in whole or in part) at any time without notice. We may also update this Disclaimer & Terms of Use. Continued use after changes constitutes acceptance of the updated terms.

 

 

13. Governing Law; Severability

 

This Disclaimer & Terms of Use will be governed by and construed in accordance with the laws of the jurisdiction where AKL Group LLC is formed/registered, without regard to conflict-of-law principles.

 

If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
